As the United States moves through a historical period in immigration history, the immigrant population is changing, the pandemic has resulted in extensive backlogs of permanent and temporary visas, the border pressure has reached a record high, and public support for expanded immigration has decreased.

FREMONT, CA: The U.S. is in the midst of a historical period in its immigration history, with a changing composition of the immigrant population, pent-up demand for permanent and temporary visas resulting in extensive backlogs, record pressure at the U.S.-Mexico border, and declining public support for expanded immigration.

After a few years of decline brought on by the COVID-19 public-health crisis and the Trump administration's restrictive policies and rhetoric, legal permanent and transitory immigration increased in 2022. In response to global crises, the Biden administration extended or expanded Temporary Protected Status (TPS) for certain eligible immigrants already in the U.S. and announced special humanitarian parole programs allowing migrants from many countries to temporarily enter the United States.

Record numbers of migrants encountered at the southwest border in 2022 coincided with court orders preventing the Biden administration from revoking the Title 42 public-health order authorizing the rapid expulsion of asylum seekers and other migrants. As of this writing, the administration has proposed a revised system to regulate asylum at the border, but the situation remains fluid. Biden's administration announced in January 2023 that up to 30,000 authorized newcomers from Cuba, Haiti, Nicaragua, and Venezuela would be eligible for humanitarian parole to promote orderly arrival and processing of asylum seekers and to expedite the removal of unauthorized migrants. Following this program, controversial adjustments to the U.S. asylum system were proposed.

The U.S. is home to more international migrants than any other country and more than Germany, Saudi Arabia, Russia, and the United Kingdom combined, according to mid-2020 data from the United Nations Population Division. While the U.S. population represents approximately 5 percent of the global population, it is home to nearly 20 percent of all international migrants.

Compiling the most authoritative and up-to-date data available, this Spotlight provides information on the approximately 45,3 million immigrants in the United States in 2021. It provides an overview of historical immigration trends in the United States and sociodemographic data regarding who is immigrating, through what channels, and how many immigrants become naturalized citizens. It also provides information about the government's enforcement actions and visa adjudication efforts.

How often are undocumented immigrants halted at the border annually?

U.S. CBP reported nearly 2.8 million enforcement encounters at the southern and northern borders in the fiscal year 2022, a significant increase from 2 million in the fiscal year 2021 and 647,000 in the fiscal year 2020 when the pandemic stifled global movement.

The overwhelming majority of these encounters (2.4 million) occurred at the U.S.-Mexico border in the fiscal year 2022. This is the greatest number of recorded encounters, surpassing the peak of 1,6 million in FY 2000. Beginning in March 2021, enforcement encounters at the Southwest border increased significantly. Motivations for migrants seeking asylum in the United States vary, but the overall rapid increase in arrivals reflects the uneven economic impacts of the COVID-19 pandemic; crises in the Americas, including significant displacement from Cuba, Haiti, Nicaragua, and Venezuela, as well as ongoing violence in Central America; political persecution and other factors driving emigration from China, India, Russia, and Turkey; the change in U.S. presidential administrations and perceptions; and the change in U.S. presidential administrations and perceptions.

Notably, data on encounters refer to individual actions, not the number of individuals who attempted to illegally cross the border. The Title 42 order to immediately expel migrants during the COVID-19 pandemic, which remains in effect until at least mid-May 2023, has altered the consequences for individuals crossing the border. As a result, many have attempted to cross the border multiple times, increasing the number of encounters.

Chatham, New Jersey – SHIFT HR Compliance Training , an attorney-founded workplace training company, today announced Manager in Minutes, a growing series of short, focused courses designed for the workplace situations managers regularly face. The series helps managers build the judgment to recognize potential risk and make better decisions in the moment. Manager in Minutes combines training on key compliance responsibilities with the everyday management skills managers need to put that knowledge into practice. The series currently includes FMLA and ADA , with Wage & Hour (FLSA), Interviewing, and Effective Performance Management coming next. Additional topics include Effective Listening , Giving and Receiving Feedback , and Belonging . “Managers are dealing with employment issues every day, often before HR even knows there is an issue,” said Katherin Nukk-Freeman, Co-Founder and President of SHIFT HR Compliance Training. “They don't need to become employment law experts. They need to know how to handle that first conversation and recognize when it's time to bring in HR.” What starts as a routine conversation can surface issues managers need to be prepared for. An employee asking for time off may say something that raises an FMLA question, or someone may casually mention working after hours. In other situations, a manager may learn something that needs to reach HR even though the employee never intended to make a formal complaint. “We hear from HR leaders all the time that managers are one of their biggest pressure points,” Nukk-Freeman said. “HR can't be in every conversation. Preparing managers for these everyday moments gives them a better sense of their role and what should happen next.” Designed to be completed in 15 minutes, each Manager in Minutes course makes practical manager development easier to fit into the workday. Through realistic workplace scenarios, managers have a chance to work through issues before they face them on the job. They can practice how to respond and when to bring HR into the conversation. The series is part of SHIFT's focus on manager readiness and will continue to expand as new courses are introduced. “Good manager judgment comes from practice,” Nukk-Freeman said. “When managers have thought through these situations ahead of time, they're better prepared when one actually happens. They know what to pay attention to, how to respond, and when they need to bring in HR.” ...Read more
Employment law compliance forms the foundation of responsible and successful organizations. Laws governing wages, working hours, workplace safety, discrimination, leave, and termination exist to protect both employers and employees. When organizations actively comply with the regulations, they create fair, predictable, and respectful work environments.
